What To Expect

What To Expect When You Work With Us

We know that the decision to pursue a legal remedy is not an easy one. Even under the best of circumstances, the legal process can be confusing, seemingly arbitrary and quite lengthy.

That's why we encourage all of our clients to go into this with a very clear understanding of what can happen, and with realistic expectations for how events may unfold.

What You Can Do

Take it step by step
Be good to yourself. Surround yourself with supportive people. At every step along the way, we will prepare you for what's coming, and help you get ready for the litigation process.

Be prepared.
Our experienced attorneys are familiar with the tactics of the other side. We'll prepare you.

Be patient. The timeline of a case is very unpredictable, and each one is different. There are many pieces to the puzzle and many things that are out of your control. We want things to move as fast as you do, and we'll do everything we can to maintain a steady pace.

When in doubt, ask.
We will keep you updated on major developments in your case, but we also encourage you to ask questions any time you need clarification. Learn and understand as much as you can – information is the best resource you have.

Major Milestones In The Litigation Process

Filing – filing the formal papers that start the legal process. You will participate by providing the factual information that goes into the complaint.

Discovery – the formal exchange of written information at the start of the process. Your cooperation in quickly providing answers to a wide range of questions – many of which may seem unrelated or even intrusive – is critical to establishing a strong foundation for your case.

Deposition – an official oral inquiry under oath. Depositions give each side the opportunity to question you, your witnesses, your family, experts, doctors, the defendant and others. We'll make sure that you're thoroughly prepared for your deposition, and make the process as tolerable as possible.

Mediation – a first chance to work toward a settlement, in the presence of a neutral mediator. If successful, your case won't have to go to trial. Even if there is no resolution, the mediation process can help open the lines of communication and lead to further negotiations.

Trial – if no settlement is reached during mediation, your case may proceed to trial, where a judge and jury will hear both sides and return a verdict.
